Newly released surveillance and body-worn camera footage have captured the moment U.S. Immigration and Customs Enforcement (ICE) agents opened fire on a vehicle in a residential New York City neighborhood, an incident that left a 28-year-old man hospitalized and has sparked a deepening political crisis between City Hall and federal authorities. The shooting occurred on Thursday, October 8, 2026, in the Marble Hill section of Manhattan while a five-year-old child was sitting in the back seat of the targeted car.
The NYPD-released video shows plainclothes agents—including one individual wearing a bright yellow reflective construction vest—rushing toward a silver Honda CR-V with their firearms already drawn. According to New York City Police Commissioner Jessica Tisch, at least one ICE agent fired seven rounds during the encounter. The driver, identified as Oscar Bergal, was struck by the gunfire but his son, who remained in the vehicle throughout the shooting, was not physically harmed.

Department of Homeland Security (DHS) Secretary Markwayne Mullin defended the agents’ actions on Friday, stating the “targeted enforcement operation” escalated when Bergal allegedly attempted to use his vehicle as a weapon to ram the officers. Mullin maintained that the agents fired because they feared for their lives. However, Bergal’s legal team and local officials have questioned the necessity of the force used, especially given the agents’ plainclothes appearance and the presence of a child.
The incident has triggered a sharp rebuke from New York City Mayor Zohran Mamdani, who characterized the shooting as an “outrage.” Mamdani has formally called for the withdrawal of ICE operations from the city, heightening the tension between local sanctuary policies and federal immigration enforcement. Following the shooting, hundreds of protesters gathered in Manhattan and near the New York-Presbyterian Allen Hospital to voice opposition to the agency’s tactics.
Bergal was transferred on Friday from a medical facility to the Metropolitan Detention Center in Brooklyn, where he remains in federal custody. His attorneys stated in a Manhattan court that a bullet remains lodged in Bergal’s neck as of October 9, and they further alleged that the agents did not possess a valid warrant at the time they approached his vehicle.
The shooting remains under scrutiny as investigators review the conflicting accounts of whether the vehicle moved before or after the agents drew their weapons. While DHS officials emphasize the danger posed to agents during the arrest attempt, city leaders continue to point to the risk posed to the public and the child in the line of fire.
